By accessing or using the Website, making a donation through the Website, or registering for or participating in the Sweat with Pride Challenge, you acknowledge that you have read, understood, and agree to be bound by, and to comply with, these Terms of Service (Terms):

About these Terms

These Terms govern your use of the Website, donations to Sweat with Pride, and participation in the Challenge. They form a legally binding agreement between you and Rainbow Giving Australia Limited (ABN 37 613 812 203) (RGA).

If you do not agree to the Terms, you must not use the Website, make a donation, or participate in the Challenge.

Background

Sweat with Pride is a fundraising initiative operated in Australia by RGA and its service providers under an exclusive licence from Burnett Foundation Aotearoa.

RGA is a public company limited by guarantee and a charity registered with the Australian Charities and Not-for-Profits Commission (ACNC). RGA’s purpose is to provide benevolent relief to LGBTIQ+ people and communities.

RGA is also the Trustee for the Rainbow Giving Australia Community Charity Trust (ABN 20 825 145 112) (Trust). The Trust is an ACNC registered charity endorsed by the Australian Taxation Office (ATO) as an Item 1 Deductible Gift Recipient (DGR-1).

All donations and other monetary contributions raised through Sweat with Pride (Funds) are made to the Trust. This enables donations over $2 to be tax-deductible.

Interpretation

In these Terms, some words have particular meanings:

  1. Challenge means the challenge to move for 21 minutes or more per day for the month of June, advertised as part of Sweat with Pride, and includes all Physical Activities and Fundraising Activities.
  2. Fundraising Activities means any activity other than Physical Activities undertaken ****in connection with ****the Challenge, ****including but not limited to using the Website, posting content in connection with Sweat with Pride, soliciting donations, raising awareness or hosting or participating in events.
  3. Physical Activities means any exercise, training, sport, movement, or exertion undertaken as part of, or in connection with the Challenge, including but not limited to walking, strength training, cardiovascular exercise, stretching, cleaning, conditioning and group fitness activities.
  4. Website means ****the Sweat with Pride website, available at sweatwithpride.org.au and hosted through third-party fundraising platform, Funraisin (including all fundraising pages and resources posted on the Website), and all official social media accounts for Sweat with Pride in Australia.
